Battery Covers Limited ("Battery Covers", "we", "us", "our") is a company registered in England and Wales. We manufacture and sell solar battery and inverter enclosures through our website at www.batterycovers.co.uk, which is powered by Shopify.

For the purposes of UK data protection law, Battery Covers Limited is the data controller of the personal information we collect about you, except where we act as a data processor on behalf of a third party (see Section 6, Wholesale and Drop Shipping Arrangements).

2.1 Information You Provide Directly

      Contact details: name, email address, phone number, billing address, shipping/installation address

      Financial information: payment card details and transaction information (processed securely via Shopify Payments or our payment provider; we do not store full card details ourselves)

      Account information: username, password, preferences and settings

      Installation address: where this differs from your billing address, we collect this separately for fulfilment purposes

      Communications: information you include when contacting us by email, phone, or contact form

2.2 Information Collected Automatically

      Device and browser information: IP address, browser type, operating system, device identifiers

      Usage information: how you navigate and interact with our website, pages visited, time spent, links clicked

      Cookie data: information collected via cookies and similar tracking technologies. Please see our Cookie Policy for full details

      Transaction history: items viewed, added to cart, purchased, or returned

2.3 Information from Third Parties

      Advertising platforms: Meta (Facebook and Instagram), Google, and LinkedIn may share data with us about your interactions with our advertisements, subject to your platform privacy settings and our cookie consent process

      Analytics providers: Google Analytics provides aggregated and anonymised data about website usage

      Shopify: as our platform provider, Shopify collects and processes certain data in connection with providing the Services. Please see Section 8 for further details

4. How We Use Your Personal Information

4.1 Fulfilling Your Order

We use your personal information to process and fulfil your orders, arrange shipping and delivery, communicate with you about your purchase, and handle returns, replacements, or warranty claims. This includes sharing your delivery details with our courier and fulfilment partners.

4.2 Account Management

If you create an account with us, we use your information to manage that account, remember your preferences, and provide you with a consistent shopping experience. We will contact you if your account has been inactive for 3 years to ask whether you wish to keep it active before we delete your data.

4.3 Marketing Communications

With your consent, we use your email address to send you marketing communications via Klaviyo, our email marketing platform. You can unsubscribe at any time using the link in any marketing email, or by contacting us directly at toby@embracerenewables.com.

We do not send SMS marketing.

4.4 Advertising and Retargeting

We use advertising platforms including Meta (Facebook and Instagram), Google Ads, and LinkedIn to show you advertisements for our products. This may include retargeting, meaning you will see our adverts on other websites or platforms after visiting ours, based on cookie data and your consent preferences.

We also use the Facebook Pixel on our website, which tracks certain actions you take and shares this data with Meta to help us measure the effectiveness of our advertising. This is subject to your cookie consent.

You can manage your advertising preferences through your cookie consent settings on our website, or through the privacy settings on each advertising platform.

4.5 Analytics

We use Google Analytics to understand how visitors use our website. This data is aggregated and used to improve our website and services. Google Analytics data is subject to your cookie consent preferences.

4.6 Fraud Prevention and Security

We use your information to detect and prevent fraudulent or malicious activity, protect the security of our website and systems, and verify your identity where required.

4.7 Legal Compliance

If you contact us with an enquiry, whether or not you proceed to purchase, we will use your contact information to respond to you and maintain a record of that communication for up to 2 years.

 

 

5. Who We Share Your Personal Information With

We do not sell your personal information. We may share your data with the following categories of third party, strictly for the purposes described in this policy:

5.1 Shopify

Our website is hosted and powered by Shopify. Shopify processes certain personal data in connection with providing the platform and its services. For further information, see Section 8 and Shopify's Privacy Policy at privacy.shopify.com.

5.2 Payment Processors

Payment information is processed securely by our payment provider. We do not store full card details. Your payment data is handled in accordance with PCI DSS standards.

5.3 Couriers and Fulfilment Partners

To deliver your order, we share your name, delivery address, and phone number with our courier and fulfilment partners. These partners process your data only for the purpose of delivering your order.

5.4 Email Marketing via Klaviyo

We use Klaviyo to manage and send our email marketing communications. If you have consented to marketing, your name and email address will be shared with Klaviyo and processed in accordance with their privacy policy at klaviyo.com/legal/privacy.

5.5 Advertising Platforms

Subject to your cookie consent, we share certain data with our advertising partners:

      Meta Platforms (Facebook and Instagram), including via the Facebook Pixel, to serve and measure targeted advertisements

      Google, via Google Ads and Google Analytics, to serve advertisements and analyse website performance

      LinkedIn, to serve targeted advertisements to professionals

Each of these platforms operates under its own privacy policy and provides tools for you to manage your advertising preferences.

5.6 Professional Advisers

We may share your information with our legal advisers, accountants, or insurers where necessary for the running of our business. These parties are bound by confidentiality obligations.

5.7 Legal and Regulatory Bodies

We may disclose your information to law enforcement, regulatory authorities, or courts where required to do so by law, or where necessary to protect our rights or the rights of others.

5.8 Business Transfers

If Battery Covers Limited is involved in a merger, acquisition, or sale of assets, your personal information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have.

 

 

6. Wholesale and Drop Shipping Arrangements

Where we fulfil orders on behalf of wholesale or trade customers, and those customers provide us with their end customer's delivery details (name, address, phone number) for the purpose of direct delivery, we process that end customer's data as a data processor acting on behalf of our wholesale customer.

In these circumstances, our wholesale customer is the data controller for that end customer's data, and is responsible for ensuring that their end customer has been informed of how their data will be used. We process this data solely for the purpose of fulfilling the delivery and do not use it for any other purpose.

 

 

7. How Long We Keep Your Data

We retain your personal information only for as long as necessary for the purposes for which it was collected, or as required by law. The table below sets out our standard retention periods:

 

Customer order data

      Retention period: 7 years

      Reason: HMRC legal requirement

 

Customer account data

      Retention period: 3 years from last activity

      Reason: Legitimate interests. We will contact you before your data is deleted.

 

Enquiries that do not result in a purchase

      Retention period: 2 years from last contact

      Reason: Legitimate interests

 

Marketing preferences

      Retention period: Until opt out or 3 years of inactivity

      Reason: Consent and Legitimate interests

 

Fraud prevention and security records

      Retention period: Up to 7 years

      Reason: Legal obligation and Legitimate interests

 

Where your account has been inactive for 3 years, we will contact you before deleting your data. Where an enquiry has not resulted in a purchase after 2 years, we will delete your contact information unless you have otherwise consented to continued contact.

 

 

8. Our Relationship with Shopify

Our website is hosted by Shopify Inc. Shopify collects and processes personal information about your access to and use of our website in order to provide and improve the platform. Information you submit may be shared with Shopify and processed in countries other than where you reside.

Shopify may also use certain data collected from your interactions with our store, along with other Shopify merchants, to provide enhanced platform features. 9. International Data Transfers

Some of the third parties we work with, including Shopify, Meta, Google, LinkedIn, and Klaviyo, may process your personal information outside of the United Kingdom. Where this occurs, we ensure that appropriate safeguards are in place in accordance with UK GDPR requirements, including:

      Standard Contractual Clauses (SCCs) approved by the UK Information Commissioner

      Transfers to countries that have been granted adequacy decisions by the UK

      Other recognised transfer mechanisms as appropriate

You have the right to ask us to delete your personal information in certain circumstances, for example where it is no longer necessary for the purpose for which it was collected, or where you withdraw consent.

You have the right to ask us to restrict how we process your personal information in certain circumstances, for example while we investigate a complaint about accuracy.

11.5 Right to Data Portability

Where we process your data on the basis of consent or contract, and by automated means, you have the right to receive your data in a structured, commonly used, machine readable format, and to request that we transfer it to another organisation where technically feasible.

11.6 Right to Object

You have the right to object to our processing of your personal information where we rely on legitimate interests as our lawful basis. You also have an absolute right to object to your data being used for direct marketing purposes.

11.7 Rights Related to Automated Decision Making

You have the right not to be subject to decisions made solely by automated processing that have a legal or similarly significant effect on you. We do not currently carry out such automated decision making.

11.8 Withdrawal of Consent

Where we rely on your consent to process your personal information (such as for marketing emails or non essential cookies), you have the right to withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

We will not charge a fee for handling your request unless it is manifestly unfounded or excessive, in which case we may charge a reasonable fee or decline to respond.

 

 

12. Children's Data

Our website and services are not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us at toby@embracerenewables.com and we will delete it promptly.

13. Security of Your Information

Our website is hosted on Shopify's secure platform, and all payment processing is handled in accordance with PCI DSS standards.

However, no method of transmission over the internet is completely secure. While we do our best to protect your personal information, we cannot guarantee absolute security. We recommend that you do not share sensitive information over unsecured channels.

In the event of a personal data breach that is likely to affect your rights and freedoms, we will notify you and the ICO in accordance with our obligations under UK GDPR.
